Terms of Use

These Terms of Use ("Terms") govern your use of the Rotely app ("Rotely", the "App") on iPhone, iPad and Mac, provided by DACCAA Ltd ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Eligibility

Rotely is not directed to children. By using the App, you confirm that you are legally able to accept these Terms under the laws that apply to you. If you are under the age of digital consent in your region, you should use the App only with the permission of a parent or legal guardian. If you buy a Rotely Pro subscription, you confirm that you are permitted to make purchases using your Apple Account.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes, subject to these Terms and the App Store’s rules.

3. Free Version and Rotely Pro

Rotely is free to download. The free version includes up to 6 packs and up to 20 cards per pack, along with the core features described on our website and in the App.

Rotely Pro is an optional subscription that removes the pack and card limits and unlocks additional features, including AI pack generation, AI answer completion, on-device translation, Quiz Mode, Weakest Cards and Focus On. The features included in Rotely Pro are shown in the App before you subscribe.

4. Subscriptions, Billing and Renewal

• Rotely Pro is available as a monthly or annual auto-renewing subscription. Current prices are shown in the App before you confirm a purchase.
• Payment is charged to your Apple Account when you confirm your purchase.
• Your subscription renews automatically at the end of each period, at the then-current price, unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Your Apple Account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your Apple Account settings. Cancelling stops future renewals; you keep access to Rotely Pro until the end of the period you have already paid for.
• Purchases are processed by Apple. We do not receive or store your payment card details.

5. Refunds

All purchases are made through the App Store, so refunds are handled by Apple under its own policies. You can request a refund at reportaproblem.apple.com. We are unable to issue refunds directly. This does not affect your statutory rights as a consumer.

6. If Your Subscription Ends

If your Rotely Pro subscription ends, your packs and cards are not deleted. You can continue to open and study everything you have already created, but you will not be able to create new packs or cards beyond the free limits, and Rotely Pro features will no longer be available until you subscribe again.

7. Legacy Purchases

If you bought Rotely (or Flashcards by DACCAA) before the free and Rotely Pro model was introduced, you keep the features you originally paid for, without the free version’s pack and card limits. Features introduced as part of Rotely Pro, such as AI pack generation and Quiz Mode, require a Rotely Pro subscription.

8. AI Features

AI features require a device that supports Apple Intelligence, with Apple Intelligence turned on. They are provided using Apple’s technology, either on your device or through Apple’s Private Cloud Compute, and their availability depends on Apple, your device, your region and your language settings. We cannot guarantee that AI features will be available on every device.

AI-generated packs, answers and translations may be incomplete or inaccurate. Please check AI-generated content before relying on it for study, exams or anything important.

9. Your Content

The packs, cards, images, video and other content you add to Rotely belong to you. You are responsible for making sure you have the right to use any content you add, and for any content you share with others as a .rotely file.

Your content is stored on your device and, if you use iCloud sync, in your own iCloud account. We do not have access to it. We recommend keeping your own backups, for example by exporting packs as .rotely files.

10. Acceptable Use

You agree not to misuse the App, including by attempting to interfere with its normal operation, reverse-engineer or copy it, bypass its subscription features, or use it in a way that breaks any applicable law.

11. Privacy

Rotely does not require you to create an account. Our Privacy Policy explains what information is processed when you use the App, including when you contact us through the in-app contact page and when you subscribe to Rotely Pro.

12. Intellectual Property

All rights, title and interest in and to the App, including its design, software and trademarks, belong to DACCAA Ltd or its licensors. This does not include your own content. You may not copy, modify, distribute, sell or lease any part of the App unless we give you written permission.

13. Third-Party Services

The App relies on Apple services (such as the App Store, iCloud and Apple Intelligence) and uses RevenueCat to manage subscriptions. Your use of Apple services is governed by Apple’s terms and policies.

14. Apple

These Terms are between you and DACCAA Ltd, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Disclaimer of Warranties

To the extent permitted by law, the App is provided "as is" and "as available". We do not guarantee that the App will be error-free or uninterrupted. Nothing in these Terms affects your statutory rights as a consumer.

16. Limitation of Liability

To the fullest extent permitted by law, DACCAA Ltd will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of or relating to your use of the App. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

17. Changes to the App or Terms

We may update the App, its features or these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continued use of the App after changes means you accept the updated Terms. Changes to subscription prices are handled through the App Store, which will tell you in advance where required.

18. Termination

We may terminate or suspend your access to the App if you breach these Terms. You may stop using the App at any time by uninstalling it. Uninstalling the App does not cancel a Rotely Pro subscription; please cancel it in your Apple Account settings.

19. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer, you may also have rights under the laws of your country of residence.
